    страх. молоточная оговорка* (неформальное название условия в некоторых полисах страхования ответственности, заключающегося в том, что за страховщиком закрепляется право проводить с пострадавшими лицами или их представителями переговоры о величине компенсации, а если застрахованный не согласиться и будет настаивать на пересмотре величины компенсации, то ответственность страховщика будет ограничена суммой, согласованной страховщиком и пострадавшей стороной; напр., если страховщик договориться с пострадавшим о внесудебном урегулировании претензии с выплатой компенсации в размере 50 тыс. долл., а застрахованный будет настаивать на проведении судебного разбирательства, надеясь на более мягкое решение суда, но сумма компенсации, определенная судом, составит 100 тыс. долл., то в соответствии с "молоточной оговоркой", страховщик выплатит только 50 тыс. долл. за вычетом франшизы по полису, а остальную часть суммы застрахованный будет покрывать самостоятельно, даже если фактический лимит страхового покрытия по полису установлен в сумме большей, чем 50 тыс. долл.)
